Article 1: Definitions and Applicability

  • Nightingale Karaokebar: The user of these general terms and conditions, acting under the name Nightingale Karaokebar, with its registered office in Nijmegen.
  • Customer: Every natural person or legal entity that enters into an agreement with the Karaoke Bar for the rental of a room or the purchase of catering services.
  • Visitor: Every person present in the catering establishment, regardless of whether they are the customer who made the reservation.
  • Applicability: These conditions apply to all offers, reservations, and agreements.
  • Deviations: Any deviations from these terms are only valid if they have been recorded in writing.

Article 2: Reservation, Deposit, and Conclusion

  • Conclusion: An agreement is formed at the moment Nightingale Karaokebar confirms a reservation in writing or digitally.
  • Deposit Rights: Nightingale Karaokebar has the right to require a deposit for reservations.
  • Payment Deadline: A deposit must be paid within 24 hours (if the reservation does not start within 24 hours).
  • Short-term Deadline: If a reservation starts within 24 hours, the deposit must be paid within 1 hour.
  • Cancellation for Non-payment: If a required deposit is not paid on time, Nightingale Karaokebar reserves the right to cancel the reservation without further notice of default.

Article 3: Cancellation by the Customer

  • Method: Cancellations must be made in writing (via e-mail) or, if the booking was made through a reservation system, cancelled via that system.
  • Fees: If a prepayment has been made, the following cancellation fees apply:
    • More than 72 hours before commencement: Free of charge, though any deposit will be returned minus a €5 administration fee.
    • 72 to 48 hours before commencement: 25% of the reservation value.
    • 48 to 24 hours before commencement: 50% of the reservation value.
    • Within 24 hours before commencement or no-show: 100% of the reservation value.
  • Non-refundable Costs: Transaction, service, and/or booking costs are non-refundable at all times.

Article 4: Changes by the Customer

  • Method: Customers must submit all changes in writing (via e-mail) or through the reservation system used for the booking.
  • Availability: Changes are possible based on availability, and the following fees apply to the difference in value:
    • More than 72 hours before commencement: Free of charge, with any deposit returned minus a €5 administration fee.
    • 72 to 48 hours before commencement: 25% of the difference between the new and old reservation value.
    • 48 to 24 hours before commencement: 50% of the difference between the new and old reservation value.
    • Within 24 hours before commencement: 100% of the difference between the new and old reservation value.
  • Example: If you reserved a room for 8 people for €200 (€25 per person) and wish to change it to 6 people between 72 and 48 hours before the start, the reservation value decreases by €50. The fee is 25% of that €50 difference; you would receive €37.50 back or choose to have it deducted from your final bill.

Article 5: Use of the Facilities and Damage

  • Responsibility: The Customer is responsible for the correct use of the karaoke room and the equipment provided, including screens, tablets, microphones, and the sound system.
  • Damage Clause: The Customer is directly liable for damage to equipment, interior, or furniture caused by improper use, such as dropping, throwing, or spilling drinks.
  • Repair Costs: The Karaoke Bar uses indicative repair/replacement costs, without prejudice to the right to full compensation.
  • Joint Liability: The Customer is jointly and severally liable for the behavior and damage caused by all members of their party.

Article 6: Access, House Rules, and Order

  • Refusal of Access: Nightingale Karaokebar reserves the right to refuse access based on (suspected) intoxication, aggressive behavior, or failure to comply with dress codes.
  • Strict Prohibitions: It is strictly forbidden within Nightingale Karaokebar to:
    • Consume self-brought drinks or food.
    • Smoke or vape inside the premises, including rooms, toilets, corridors, or the bar.
    • Stand on tables or benches.
    • Possess or use prohibited substances (as listed in Schedule II of the Opium Act) or other (designer) drugs.
  • Consequences: In the event of a violation of the house rules, access may be denied immediately, and the session may be terminated without the right to a refund.

Article 7: Liability of the Karaoke Bar

  • Personal Property: Nightingale Karaokebar is not liable for the loss, theft, or damage of visitors’ personal property.
  • Liability Limit: Total liability for an attributable failure is limited to a maximum of the reservation amount.
  • Indirect Damage: Nightingale Karaokebar is never liable for indirect damage, such as consequential loss or the customer’s lost profits.

Article 8: Force Majeure

  • Rights: In case of force majeure (e.g., technical failures of the karaoke system, fire, government measures, or strikes), Nightingale Karaokebar has the right to dissolve the agreement or move the booking without being liable for damages.
  • Technical Defects: If a session is interrupted halfway due to a technical defect without the customer’s involvement (intentional or otherwise), Nightingale Karaokebar will refund pro-rata or offer a replacement date.

Article 9: Privacy and Camera Surveillance

  • CCTV: For the safety of guests and staff and the protection of property, camera surveillance may be used (under strict conditions) in general areas, private karaoke rooms, and corridors.
  • Data Processing: Personal data is processed in accordance with the GDPR (AVG) and is used only for the safety of guests/staff, reservations, and administration.
